Work Session
October 9, 2007
Present were: Councilors Cusson, Bigelow, Lafleur, Poulin, Grenier, Boucher, and Nelson (6:45 p.m.); absent were Mayor Danderson and Councilor Donovan. Patrick MacQueen, media and public were also present.
In the absence of Mayor Danderson, Councilor Lafleur moved to elect Councilor Grenier Mayor Pro Tem for the meeting; Councilor Cusson seconded and the motion carried.
Jericho Lake Agreement
Mr. MacQueen reported that the right of reverter and mineral rights are not in the agreement approved by the Attorney General's office. The property is restricted to recreational use due to the grant stipulations it was purchased with. The issue of gravel rights was initiated by BWW and the State will not agree to put the rights in this agreement; however they are willing to pursue the gravel rights under a separate process.
Mr. MacQueen went on to say that after the State acquired the property for an ATV park, they asked for an easement to cross BIDPA property on Route 110. Because of the topography of the parcel, the easement is around the perimeter of the developable property. The State has agreed to delete #17 on page 5.
Councilor Bigelow asked where the state is with respect to the environmental issues around the trail. Mr. MacQueen responded that legislation has been adopted and DRED is confident that trails can be developed. He noted that he would like an update from the State about the amount of trails to come in the next 5 years.
Councilor Cusson moved to issue a quit claim deed to the Division of Forest and Lands as proposed; Councilor Lafleur seconded and the motion carried.
Councilor Cusson moved to enter into an agreement with the Division of Forest and Lands to allow the easement over property on Route 110 to take place; Councilor Lafleur seconded and the motion carried.
Non-Public Session
Councilor Lafleur moved to go into non-public session per RSA 91-A:3 II (d) Consideration of the acquisition, sale or lease of real or personal property which, if discussed in public, would likely benefit a party or parties whose interests are adverse to those of the general community; Councilor Cusson seconded and the motion carried unanimously by roll call.
Councilor Nelson moved to seal the minutes as their release would render the proposed action ineffective; Councilor Lafleur seconded and the motion carried unanimously by roll call.
Councilor Lafleur moved to come out of non-public session; Councilor Cusson seconded and the motion carried unanimously by roll call.
Councilor Lafleur moved to adjourn; Councilor Nelson seconded and the motion carried.
